Olivier Martinez and Halle Berry‘s custody dispute has led to another court filing, this time involving a $240,000 request for legal fees. Martinez is asking his ex-wife to cover his legal expenses, citing financial difficulties and his inability to keep up with the costs of their ongoing legal battle. The request comes as the former couple continues to navigate disagreements over custody of their 13-year-old son Maceo.
Olivier Martinez Files Formal Request For Coverage Of Legal Fees

Halle Berry and Olivier Martinez are in the middle of a legal dispute over the custody of their son, Maceo. In October, Martinez accused Berry of physically assaulting their son and filed for a restraining order and sole physical and legal custody of the child.
The two sides have faced multiple court hearings as their dispute continues, with legal expenses mounting for both parties. Martinez has added another element to the court battle and filed a formal request to have Berry cover his fees.
On November 4, as reported by the Daily Mail, the actor petitioned the court to have his ex pay $240,000 in legal bills, saying that he does not have the capacity to cover the costs. “While Petitioner and I are both actors, our respective incomes and access to assets vastly differ,” the document noted.
The Actor Submitted A Detailed Document Of His Current Financial Standing

Martinez is a French actor known for appearing in films such as “Unfaithful,” “Dark Tide,” and “The Physician.” His most recent big-screen appearance was in the 2024 film “Hunting with Tigers,” and he said in his filing that he hasn’t had acting roles “for years.”
Berry, on the other hand, appeared in the heist movie “Crime 101” in February and has a slate of projects that are in development or in post-production.
Martinez claimed he receives monthly residual checks averaging $776.34 and has $43,206.22 spread across different accounts. For the previous month’s residuals, he only earned $288.33. Furthermore, the documents disclosed his average monthly living expenses, which amounted to $17,555.99. His only major asset is a real estate property with an estimated value of $550,000.
Currently, his legal fees amount to $176,522.58, but amid the ongoing battle, the amount is expected to reach up to $240,000, per TMZ.
Inside Halle Berry And Olivier Martinez Most Recent Court Battle

Berry and Martinez have spent more than a decade navigating legal disputes, beginning with their 2015 divorce proceedings, which were not finalized until 2023. Their disagreements continued in the years that followed, with the exes returning to court between 2024 and 2025 due to co-parenting issues.
Their latest legal clash has brought competing allegations from both sides, with each claiming a different account of the situation.
Martinez alleged Berry physically abused their son, claiming she has a pattern of behavior that has left Maceo traumatized. Berry, on the other hand, refutes the abuse claims, accusing her ex of retaliation and citing his documented history of his “erratic, possessive, and violent behavior.”
- Halle Berry claimed Maceo returns to her “angry and combative” after spending time with Olivier Martinez.
- The actress’ daughter alleges her mother’s ex is on a “quest to destroy” Halle Berry.
- She accused her ex-husband of putting messages out of context amid their custody battle.
- A source alleged that Halle Berry’s public image doesn’t match her private persona.
- Halle Berry and Olivier Martinez’s divorce was settled after eight years.
The Restraining Order Against Halle Berry Was Lifted

The nine-day court proceeding concluded on October 29 with Judge Shelley Kaufman dissolving the restraining order against Berry, citing that Martinez was unable to meet the required burden of proof.
Despite dismissing the claims of abuse, the judge did not reinstate the exes’ former 50/50 shared custody arrangement of Maceo and awarded primary physical custody to Martinez temporarily. The actress has limited visitation hours and is barred from having overnight stays with her son.
Moreover, the court ordered the mother and son to attend therapeutic sessions in an effort to repair their relationship.
Olivier Martinez And Halle Berry’s Custody Battle Is Not Over

Berry’s attorney noted that they are “extremely pleased” about the dissolved restraining order. “As we move forward, Halle is determined to continue to focus on the well-being and best interests of her family,” per USA Today.
Martinez’s attorney, on the other hand, said the current custody arrangement is a “huge victory” for his client.
Despite the rulings, the custody battle is far from over. Both sides are expected to return to court later this month for a custody review hearing, where the judge will evaluate the current arrangement and consider whether to lift restrictions or modify the custody schedule.
Meanwhile, the court has yet to rule on Martinez’s request for Berry to cover his legal fees.
